LevFria Terms of Service

1. Introduction

LevFria is a consumer-facing wellness platform designed to:

• Assess personal fall risk factors
• Provide evidence-based strength and balance exercises
• Track progress and build healthy habits
• Support proactive aging and independence

Note: These terms supplement the General Terms of Service and Privacy Policy.

2. Health and Wellness Disclaimers

2.1 Not Medical Advice

LevFria is a wellness tool, not a medical device or healthcare provider. It does not provide:

• Medical diagnosis
• Medical treatment or prescriptions
• Clinical advice from healthcare professionals
• A substitute for professional healthcare

LevFria provides:

• Educational wellness information
• Estimated fall-risk insights
• Exercise recommendations for general health
• Motivation for healthy habits

2.2 Critical Health Notice

If you have health concerns, pre-existing conditions, or take medications:

1. Consult your healthcare provider before using LevFria exercises
2. Inform your doctor about fall-risk insights from LevFria
3. Seek professional medical evaluation if you experience pain, dizziness, or adverse effects
4. Call 112 immediately for medical emergencies

Do not delay professional medical care while using LevFria.

2.3 Assumption of Risk and Release

By using LevFria, you acknowledge and accept that:

1. You use LevFria at your own risk
2. Assessments are estimates, not clinical diagnoses
3. Exercise recommendations are general guidance, not personalized medical treatment
4. You assume full responsibility for health decisions and outcomes
5. You will consult a healthcare professional before starting new exercises
6. You release NSD from liability for health-related outcomes
7. You will not hold NSD liable for falls, injuries, or health deterioration

3. Age Requirements and Eligibility

3.1 Minimum Age

• General Use: Must be at least 16 years old
• Health Assessment Features: Designed for users 65+ or caregivers of older adults
• NSD may terminate accounts of users under 16

3.2 Capacity and Legal Authority

By creating an account, you represent that:

• You are of legal age and capacity to agree to these Terms
• You are not under court-ordered restrictions affecting digital services
• If you are a caregiver, you have legal authority (power of attorney, guardianship, etc.)

4. Account Creation and Use

4.1 Account Registration

To use LevFria, you must:

• Provide truthful, accurate information (name, email, age)
• Create a strong password
• Accept these Terms and the Privacy Policy
• Agree to health disclaimers

4.2 Account Confidentiality

You are responsible for:

• Keeping your password confidential
• Not sharing login credentials
• Logging out on shared devices
• Reporting unauthorized access immediately

4.3 Account Deletion

You may delete your LevFria account anytime:

• In-App: Settings → Account → Delete Account
• Email: dataprotection@nextstepdynamics.com

Effect: All personal data is deleted per Privacy Policy. Deletion is irreversible.

5. LevFria Features and Functionality

5.1 Fall-Risk Assessment

What it does:

• Collects responses to a questionnaire based on fall-risk research (DFRI)
• Calculates estimated fall-risk score (low, medium, high)
• Suggests exercises and lifestyle changes

What it is NOT:

• A clinical diagnostic tool
• A medical assessment performed by a healthcare professional
• A prediction of actual fall probability
• A substitute for professional fall-risk evaluation

How to use:

1. Answer questions honestly
2. Review your estimated risk score
3. Discuss results with your healthcare provider
4. Use recommended exercises as general guidance (with professional approval)

5.2 Exercise Library

LevFria provides:

• Video demonstrations of strength and balance exercises
• Difficulty levels (beginner, intermediate, advanced)
• Repetition and frequency guidance
• Progress tracking

Not medical treatment:

• Exercises are general recommendations
• Not prescribed by a healthcare professional
• May not be appropriate for all conditions

Always consult a physical therapist for personalized plans.

5.3 Progress Tracking

LevFria allows you to:

• Log exercise completion
• Track balance and strength improvements
• Set personal health goals
• View activity history

Data use:

• Tracked data improves recommendations
• Aggregated, anonymized data used for product improvement
• Your individual data is never shared without consent

6. Intellectual Property

6.1 LevFria Ownership

All LevFria content, design, software, and materials are owned by NSD and protected by copyright and IP laws:

• Platform design and UI
• Exercise videos and demonstrations
• Assessment questionnaires
• Logos and branding
• Algorithms and calculations

6.2 Limited License to Use

We grant you a personal, non-commercial license to:

• Access LevFria for your own wellness use
• View, read, and interact with content
• Download exercises for personal use (where allowed)

You may not:

• Copy, reproduce, or distribute LevFria content
• Create derivative works
• Share exercise videos publicly or commercially
• Reverse-engineer or decompile the app
• Sell or exploit LevFria content
• Build competing apps using LevFria insights

6.3 User Health Data Ownership

You own your health data. NSD:

• Stores and protects your data per the Privacy Policy
• Uses aggregated, anonymized data for research and improvement
• Will not sell your individual health data
• Respects your rights to access, delete, or export data

7. Acceptable Use

7.1 Illegal or Harmful Activities

You agree not to use LevFria for:

• Illegal activity under Swedish law or your jurisdiction
• Harm to yourself or others
• Deception or fraudulent account creation
• Harassment, bullying, threats, or hateful content

7.2 Commercial Misuse

• Selling or reselling LevFria content
• Commercially exploiting LevFria without permission
• Building competing apps using LevFria

7.3 Security and Technical Misuse

• Scraping or extracting LevFria data
• Hacking or attempting unauthorized access
• Uploading malware or malicious code
• Disrupting availability or functionality

Consequences: Immediate account termination, legal action, and referral to authorities.

8. Third-Party Links and Resources

LevFria may link to:

• External health websites and resources
• Healthcare provider directories
• Scientific articles and research

NSD is not responsible for:

• Accuracy or completeness of external content
• Privacy practices of external sites
• Functionality or availability of links
• Any loss or damage from external sites

9. Service Modifications and Discontinuation

9.1 Service Changes

NSD may modify LevFria features, functionality, or content:

• Non-material changes: May occur without notice
• Material changes: Notified via email or in-app (typically 30 days' notice)

9.2 Service Discontinuation

NSD may discontinue LevFria:

• With 30-day notice for planned discontinuation
• Immediately if required by law or security reasons

Upon discontinuation, NSD will:

• Provide data export to you
• Offer transition assistance if alternative services are available

10. Limitation of Liability

See General Terms of Service, Section 3. Additionally, NSD is specifically not liable for:

• Falls, injuries, or health deterioration resulting from LevFria use
• Health decisions based on LevFria assessments
• Accuracy of fall-risk estimates
• Ineffectiveness of recommended exercises
• Any adverse health outcomes

11. Updates to Terms

LevFria Terms may be updated. NSD will:

• Post updated Terms with a new "Last Updated" date
• Notify you of material changes via email
• Request explicit consent for major changes

Continued use after updates constitutes acceptance.
